The opinion from the Court of Appeals Second Appellate District affirmed the conviction of Jonathan David Highley, 38, for the fatal shooting March 4,
Anthony “Tony” San Juan, 43, was fatally wounded after being shot once in the head by Highley, who had been kicked out of the Old Town Orcutt bar after he “cold-cocked” one patron and fought other customers.
Highley grabbed a gun from his nearby residence and returned to shoot San Juan in the parking lot. San Juan had not been involved in any of the altercations.
In the appeal, Highley contended that a recorded phone conversation had been admitted into evidence in error, questioned the sufficiency of other evidence and contended that the judge should have provided different instructions to jurors regarding a lesser offense.
